dang that sucks. chances are he won't be honest about it because he wasn't honest before.

you can always show up at his door every night asking for your money back. he may just pay you to leave him alone. if he gets nasty, bring the local LEO along with you to let him know you mean business.

If he's not home, Put the tailgate down, back up the lawn like a psycho GF, and then slam on the brakes. It'll be waiting for him in his living room.

BTW, what kind of rocket scientist would rip you off from his own house?

Nah, you suffer from the same thing I do...old school ideals in a new world. I guess it's foolish, but I feel better about following the "do unto others as you'd have them do unto you" rule rather than the "do unto others...then run" rule that seems prevalent today.

I think that's why I like this site so much...I'm sure there are exceptions to the rule, but for the most part folks here are good honest people that you can deal with and know you're not going to get hosed.

Besides the fact you got screwed in not getting what you paid for, the L99 isn't THAT bad of a motor. Is in an LT1...NO, but everything you can do to an LT1 you can do to that motor. Heck, some headers, some type of CAI, and some stock LT1 cam and roller rockers should make a pretty big difference! Plus, you'll get much better mileage and when you do find an LT1, it's an easy swap.

BTW...I have a stock LT1 cam and roller rockers if you are interested

Ouch. What are the chances the seller didn't know this was not as advertised? Hope it works out.

Yea there is alot of people out there that don't even know about the L99, I got into it one more than one occasion with former GM techs that kept telling me that 4.3 was a V6 and they didn't make a 4.3 V8,had to bust out some paper work to prove em wrong. Call they guy and start off like its an honest mistake first. And not to be an *** ,you should have verified the casting numbers BEFORE you paid him just for this reason.

This is the best way to avoid being taken or buying something that the seller doesn't know isn't what he claims. Here is a good site that lists some of the differences:

#1 Contact seller and tell him the problem in writing via certified mail.
#2 Follow up by phone to verify he got the letter and work on a resolution.
-discount, return, etc... (I suggest discount, as you already dismanted part of the engine)

#3. If he tells you "too bad", tell him you would like him to kindly reconsider as in a few days you will be contacting the district attourneys office. Be very nice and polite to him. keep it non personal.
#4 Follow up with your suggested resolution with a couple options in another certified mail to him.
#5 If he does not contact you again, take all your copies of certified mail, copy of the ad, and time lof and summary of events to the D/A's office.

The D/A will be very happy with your organization, persistance and paperwork, it will be an easy letter for them to write to the seller. Remember to never be mad or irate to anybody.(this will get you a long way)

That will scare the **** out of the seller.

All this will not take more than 2 hours out of your life.

You were decieved. It is called theft by deception or fraud. period. If the seller does not know what he/she is selling, they should not advertise it as being something they are not sure of. ingorance is no excuse.(example: tell a law enforcement officer that you should be let go becasue you did not know the speed limit)

And will then tell you to take it to small claims court. The D/A represents the government in prosecution of criminals. Unless JPJEEPER was buying this motor as a represenative of some level of govenrment the D/A probably can't help and small claims is where you need to go.

Certified letters and all that stuff you mentioned is a good idea and will likely scare the :o:o:o:o:o out of the guy and end up in getting your money back tho! Would be really good if you had a receipt from your transaction too.

The deal was documented in email form.

I have name, phone and address. Several times the thread references an LT1...

I sent an email off to him today and will follow up with a phone call on Tuesday.

This just sends my project to the crapper.

[edit] L99 (4.3L)

A 4.3 L version of the LT1, designated the L99, was introduced in 1994 for the Chevrolet Caprice. It was externally identical to the LT1, but the bore was reduced to 3.736" and the stroke to 3.00" (similar to the late sixties Chevrolet 302 used in the first-generation Camaro Z28s). The pistons used in the L99 were the same as the ones used in the Vortec 5000 with the use of 5.94" connecting rods.
Like the LT1, it features sequential fuel injection, reverse cooling, and an optical crank position sensor. Output is 200 hp (150 kW) and 245 ft·lbf (332 N·m).
Due to its smaller displacement, it provides better fuel economy over the 5.7L LT1.

I don't want to use this engine..

I have the whole wiring harness and computer, I would have to re-program and wire the whole harness, I don't think the computer and wiring swaps... not sure... I guess I will look at that...
